RULES OF THE COMPETITION “Where is ZR?

GENERAL PROVISIONS

  1. “Organizer” – the organizer of the Competition is the company Bacha Sport Janina Warot
    with its registered office in Gliwice, ul. Kozielska 439.
  2. The “Where is ZR” competition (hereinafter referred to as the “Competition”) is conducted in the territory of the Republic of Poland, via the website www.facebook.com/BachaSport.
  3. The prizes are sponsored by the Event Organizer.
  4. The rules of the Competition are set out in these Regulations.
  5. Taking part in the Competition is tantamount to reading and accepting these regulations.
  6. The game lasts from October 28, 2013 until the participant guesses correctly or the last (7 graphics) are completely revealed.
  7. The results of the Competition will be announced on the website www.facebook.com/BachaSport, no later than 5 days from the date of the participant’s guess or the complete unveiling of the last (7th graphic).
  8. The Organizer reserves the right to interrupt or cancel the Competition.
  9. This Competition is in no way sponsored, endorsed or administered by Facebook.
  10. The Organizer declares that the Competition is not a game of chance, a raffle, a mutual bet, a promotional lottery, the outcome of which depends on chance, or any other form of a game of chance provided for in the Act of 19 November 2009..

 COMPETITION PARTICIPANTS

  1.  “Participant” – a natural person, of legal age, with full legal capacity, residing in the territory of the Republic of Poland and meeting the conditions for participation in the Competition.
  2. Participate in Competition they cannot:

a)    employees or associates of the Organizer, as well as members of their immediate families (spouses, children, parents, siblings, including step-siblings),

b)    thepersons appointed by the Organizer to select the winners of the game,
as well as members of their immediate families,

c)    employees or associates of Bacha Sport Janina Warot and members of their immediate families.

3. By entering the Competition, the Participant consents to the use of personal data by the Organizer for the time and for the purposes of conducting this Competition, under the conditions specified in the Act.

4. of 29 August 1997 on the protection of personal data (consolidated text: Journal of Laws of 2002, No. 101, item 926)

5. The collection of personal data is entirely voluntary. Participants acknowledge that failure to provide personal data may result in the prize being withheld until such data is provided, and they confirm that they will not incur any claims in this regard.

6. The Organizer reserves the right to make public information regarding the course and results of the Competition.

7. The Organizer declares that the data will be used solely for the purpose of sending prizes. It will not be shared with third parties. It will also not be stored outside the competition database during the competition and will be deleted after its conclusion.

8. The participant has the right to access and correct his/her data. personal data in accordance with the provisions of the Act of 29 August 1997 on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended).

8. The administrator of personal data collected during this Competition is – within the meaning of the Act of 29 August 1997 on the Protection of Personal Data (consolidated text: Journal of Laws of 2002, No. 101, item 926) the Competition Organizer.

 

RULES FOR ENTRY IN THE COMPETITION

 1. The competition will be held on facebook.com on the Bacha Sport website www.facebook.com/BachaSport.

2. The condition for entering the Competition is that the Participant has to have an active Profile on the website www.facebook.com, identified by his real name and surname, and logging in to facebook.com.

3. The Organizer reserves the right to exclude from participation in the Competition:

a. a person who takes part in the Competition using several Facebook Profiles,

b. a person who takes part in the Competition using their Facebook Profile,
in which a fictitious e-mail address or a false name or surname of a given person was provided,

c. a person who provided false personal data or fictitious e-mail addresses necessary to register a competition entry or provided random e-mail addresses of people who are not his or her friends,

d. a person conducting activities for which there is a reasonable suspicion that they may lead to attempts to circumvent the Regulations or
in any other way seek to breach the security or rules of the Competition,

e. a person conducting activities that violate the legitimate interests of the Organizer or harm its image.

4. Any reasonable suspicions of the Organizer regarding irregularities influencing the outcome of the Competition by the Participant may result in the removal of the Participant from the Competition.

5. A person who has entered the Competition in accordance with the above provisions of these regulations becomes a participant of the Competition (hereinafter referred to as the Participant).

6. The person who entered the Competition consents to the processing of his or her personal data by the Client in accordance with the principles described in the Regulations.

RULES AND PROCEDURE OF THE COMPETITION

1. The game involves guessing the city shown in the photo, which was posted on the Bacha Sport website. www.facebook.com/BachaSport. You have to guess the city (town) and write the NAME OF THE CITY (in Polish) in a comment under any post with a given graphic. Providing an answer that is considered more general (continent, country, etc.) or more specific (e.g. street, square) or in a language other than Polish is not considered a correct answer. The name of the city must be spelled correctly. A correct answer must include CITY NAME (in Polish).

2. For a correct answer you can receive points as follows:

a) 1 element exposed – 4 points

b) 2 elements exposed – 3 points

c) 3 elements revealed – 2 points

d)  …

e)     Revealed 4th element + hint – 1 point

3. Only the first person to post the correct answer scores points.

4. The Organizer will provide information on whether the correct answer has already been given on the next business day after the post is published.

5. The organizer will post seven different photos depicting a specific city. Each photo will be revealed until a participant posts the correct answer or the entire image is revealed.

6. If, after the entire graphic has been revealed, no one provides the correct answer, the Organizer may, but is not obligated to, provide a hint. If no one provides the correct answer, no Participant receives a point.

7. The winner of the Competition will be the participant who collects the most points, but must earn a minimum of 5 points. If no participant earns 5 points, no winner will be selected.

8. If two or more participants score the same number of points, there will be a tiebreaker to submit one additional image. The first participant with the same number of points to submit the correct answer will be declared the winner.

9. You can join the Game at any time during its duration.

10. Participation in the Competition involves fulfilling the tasks specified in these Regulations, with the proviso that, in carrying them out, Participants are obliged to comply with all applicable legal provisions, these Regulations and generally accepted customary rules of fair play.

11. It is prohibited to post texts and comments on the “Bacha Sport” website that in any way violate applicable law or good manners. It is prohibited to post profanity, content that incites racial, ethnic, or religious hatred, content that contains pornography, praises fascism, Nazism, or communism, promotes violence, offends religious feelings, violates the rights of others, including copyrights, or otherwise violates applicable Polish law.

12. The Organizer reserves the right to remove extremely vulgar content (e.g. content with unjustified profanity, clearly offending someone’s religious feelings, etc.).

13. The Organizer may exclude a participant from participating in the Competition if the participant violates the provisions of these regulations.

AWARDS

1. The prize for first place in the Competition is one BE 5920 Elliptical Bike by BODY STYLE worth PLN 630 gross.

2. Additional prizes: Reebok Fitness folding mat worth PLN 99 gross, Reebok Fitness hand grips worth PLN 45 gross. 2x Body Sculpture branded T-shirts worth PLN 30 gross each.

3. Winners are not entitled to claim any special properties of the prizes or to receive their equivalent (cash or in kind) or to exchange the prizes.

4. Participants are not entitled to any reimbursement of costs or other expenses incurred by them for participating in the Competition. There are also no prizes awarded for participating in the Competition.

5. The Participant is not entitled to transfer the claim to a third party.

6. The Organizer is the party promising the prize within the meaning of Articles 919 and 921 of the Civil Code.

7. The Participant will be informed about the award by the Organizer via email and/or on the website. www.facebook.com/BachaSport.

8. The condition for receiving the Prize is to send your data necessary to select the Prize to the Organizer’s e-mail address.

9. The Participant has 5 days from the date of notification of winning to email the Organizer with their details. Failure to send their details within this timeframe will constitute forfeiture of the Prize.

COMPETITION COMMITTEE

1. In order to ensure the proper organization and conduct of the Competition, In particular, in order to assess the validity of entries to the Competition and to calculate points, the Organizer will appoint a Competition Jury. The Competition Jury will consist of persons selected by the Organizer.

 RULES FOR SELECTING THE WINNERS OF THE COMPETITION AND AWARDING PRIZES

1. The Competition Committee awarded the main prize – the BE 5920 elliptical bike – to the person who collects the highest number of points and meets the requirements of the regulations.

2. The remaining prizes will be awarded to participants who obtain the highest number of points and meet the requirements of the regulations.

3. Please note that each Participant may only be awarded once..

4.The prizes will be sent individually to each Winner by courier to the address provided in the message to Bacha Sport sent via Facebook..

5. The Organizer is not responsible for the actions or omissions of entities conducting courier activities delivering prizes to the Participant.

6. In the event that it is not possible to select the winner of the Game, e.g.. In the event of insufficient points, the Organizer reserves the right not to award the Grand Prize. The verdict issued by Bacha Sport Janina Warot is final.

RULES OF COMPLAINT PROCEDURE

1. Any complaints from Participants regarding the course of the Competition may be submitted by Participants within 14 days from the end of the Competition.

2. The complaint should be sent to the address of the Organiser’s registered office in writing under pain of nullity and must include the Participant’s name and surname, correspondence address and a detailed description of the circumstances constituting the basis for the complaint.

3. Complaints submitted after the deadline specified in the preceding paragraph, as well as those that do not meet the other requirements specified in the preceding paragraph, will not be considered.

4. Complaints submitted will be reviewed within 14 days of receipt. Interested parties will be notified of the complaint resolution process by registered mail sent immediately after the complaint is reviewed.

 LIMITATION OF CLAIMS

1. The Organizer is not responsible for the operation of the Internet through which Participants submit their applications, as well as through which the Organizer contacts the Participant.

2. The Organizer is not responsible for any defects in the prize. The manufacturer is responsible for any defects in the prize under the warranty or guarantee.

3. The Organizer shall not be liable if, as a result of the faulty actions of other entities (e.g. a telecommunications company or a computer network administrator) or force majeure (e.g. a natural disaster, a terrorist attack or the threat thereof), it is unable to fulfill all or part of the obligations imposed on it by the Regulations.

 FINAL PROVISIONS

1. Before taking part in the Competition, the Participant should familiarize himself/herself with the with the Rules. Entering the Competition is tantamount to the participant’s acceptance of the Competition Rules in their entirety.

2. Participation in the Competition should, in case of any doubts, be deemed to be tantamount to having read and accepted the Regulations.

3. The Participant undertakes to comply with the rules specified in the Regulations and confirms that he meets all the conditions that entitle him to participate in the Competition. Failure to meet the above-mentioned conditions or refusal to meet them will result in the exclusion of the Participant from the Competition, with the simultaneous expiration of any claims to receive prizes and any other claims related to the Competition against the Organizer, and will also entitle the Organizer to refuse to award or deliver the prize.

4. The Organizer reserves the right to verify whether Participants meet the conditions specified in these Regulations, as well as the conditions specified in the legal provisions related to the implementation of prizes.

5. The Organizer has the right to exclude a Participant from the Competition with immediate effect, as well as to refuse to award him/her a prize if the Participant has provided false or incomplete data required and necessary for the awarding of the prize.

6. In cases of detection of activities inconsistent with the Regulations, attempts to influence the selection of the winner of the Competition in an unauthorized manner, in particular by creating fictitious private profiles on the website www.facebook.com or other actions contrary to the idea and purpose of the Competition, the given Competition Participant will be excluded from the Competition.

7. The Organizer is not obliged to inform Participants about exclusion from the Competition.

8. The Organizer reserves the right to exclude from participation in the Competition Participants who are suspected of acting contrary to the with generally applicable legal provisions and the provisions of the regulations regarding the use of the website www.facebook.com.

9. These Regulations are available on the website http://www.facebook.com/BachaSport

10. The Competition Organizer reserves the right to modify the provisions of the Regulations, provided that such changes do not violate the acquired rights of the Competition Participants. Any modifications to the provisions of the Regulations will be included in the appropriate Annex to these Regulations, which will constitute an integral part of these Regulations.

11. In matters not regulated by these Regulations, the provisions of Polish law shall apply.
